Terms of Service

These terms are a contract between you and SOUMYA SUNIL WADE ("we", "us"), the operator of CBAM Exporter Tracker (the "Service"). By creating an account or continuing to use the Service, you agree to these terms. If you use the Service for an organisation, you confirm you have authority to bind it; if you use it as an individual, you confirm you are of legal age.

The Service

CBAM Exporter Tracker is online software that helps exporters record production and emissions data, calculate embedded emissions, and prepare draft evidence packages for EU importers under the Carbon Border Adjustment Mechanism. The Service does not submit declarations to EU authorities, and outputs are not a guarantee of customs acceptance or of accredited verification.

Your account

• Keep your sign-in details confidential; you are responsible for activity under your account.
• Provide accurate information and keep it up to date. You are responsible for the accuracy of data you enter.

Acceptable use

You must not misuse the Service, including: using it unlawfully; fraud or spam; infringing anyone's intellectual property; uploading malware; probing, scanning or testing vulnerabilities; scraping; reverse engineering; reselling or redistributing the Service; or circumventing plan limits or technical restrictions.

Intellectual property and licence

We retain all rights in the Service, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You keep ownership of your content and grant us a limited licence to host and process it solely to provide the Service.

Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal and cancellation terms are set out in Paddle's Buyer Terms. Refunds are described in our Refund Policy.

Service level

We work to keep the Service available and accurate but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

Liability

Our aggregate liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

Suspension and termination

We may suspend or end your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the Service at any time. After termination you may request an export of your data within 30 days, after which it is deleted.

General

You indemnify us for claims arising from your content, unlawful use, or breach of these terms. Neither party is liable for delays caused by events beyond reasonable control. You may not assign these terms without our consent. We may update these terms and will notify you of material changes.
